1. Definitions

For the purposes of these Terms & Conditions, the following terms shall have the meaning indicated below:

• Platform: the programando.io website and all associated applications, tools, features and services, operated by Digital Edge Consulting LLC.
• User: any natural person who accesses, registers or uses the Platform, whether with a free or paid account.
• Content: all educational materials available on the Platform, including but not limited to video courses, explanatory texts, code examples, interactive exercises, quizzes, hands-on projects, documentation, infographics and any other learning resource.
• Course: a structured educational program within the Platform, made up of a series of lessons, modules, exercises and assessments, aimed at learning a specific programming topic or technology.
• Subscription: the service plan contracted by the User that determines the level of access to the Platform's Content and features, which may be free (Free) or paid (Pro or Mentor).
• Certificate: the digital document issued by the Platform certifying that the User has successfully completed a given Course.
• Company: Digital Edge Consulting LLC, a limited liability company incorporated under the laws of the State of New Mexico, United States of America, with registered office in Albuquerque, New Mexico, owner and operator of the Platform.

2. Acceptance of the Terms

Access to and use of the Platform are subject to the full and unreserved acceptance of these Terms & Conditions (hereinafter, "the Terms"), which govern the relationship between Digital Edge Consulting LLC and the User. By registering on the Platform, accessing any of its Content or using any of its services, the User declares having read, understood and accepted all of these Terms, as well as the Legal Notice and the Privacy Policy.

If the User does not agree with any of the provisions contained in these Terms, they must refrain from using the Platform and its services. Continued use of the Platform after the publication of any modification of the Terms shall constitute tacit acceptance of such modifications.

The User declares being over sixteen (16) years of age and having the legal capacity necessary to accept these Terms. If the User is under 18 years of age, they declare having the consent of their parents or legal guardians to use the Platform.

3. Account registration

To access all of the Platform's features and Content, the User must create a personal account through the registration process available on the website. During registration, the User agrees to:

• Provide truthful data: all information provided during the registration process must be truthful, complete, accurate and up to date. The use of false or incomplete data, or data that does not correspond to the User's real identity, may result in the immediate suspension or cancellation of the account.
• Keep information up to date: the User undertakes to update their personal data in a timely manner in the event of any change, in order to ensure the accuracy and currency of the registered information.
• One account per person: each User may create and maintain only one personal account on the Platform. The creation of multiple accounts by the same User for the purpose of obtaining additional benefits or circumventing restrictions may result in the cancellation of all associated accounts.
• Responsibility for credentials: the User is solely responsible for maintaining the confidentiality of their access credentials (username and password). Sharing access credentials with third parties or allowing others to use their account is strictly prohibited. The User shall be responsible for all activities carried out through their account, regardless of whether they authorized such activities.
• Notification of unauthorized use: the User must immediately notify Digital Edge Consulting LLC of any unauthorized use of their account or any security breach of which they become aware, through [email protected].

Digital Edge Consulting LLC reserves the right to reject any registration request, as well as to suspend or cancel any existing account, when there are reasonable indications of a breach of these Terms or of fraudulent or abusive use of the Platform.

4. Description of the service

The programando.io Platform is an online educational service that offers Users a comprehensive learning experience in the field of computer programming and software development. The services provided by the Platform include, by way of example but not limitation:

• Online programming courses: a broad library of structured courses covering multiple programming languages, frameworks, development tools, databases, web development, mobile development, data science, artificial intelligence and other technological disciplines. The courses consist of video lessons, detailed textual explanations, commented code examples and supplementary resources.
• Integrated code editor: a browser-based development environment that allows the User to write, run and test code directly on the Platform, without the need to install additional software on their device. The editor supports multiple programming languages and provides features such as syntax highlighting, autocompletion and real-time execution.
• Hands-on exercises and projects: each course includes interactive exercises, coding challenges and hands-on projects designed to reinforce the knowledge acquired and develop skills applicable in real professional environments.
• Progress tracking: tools that allow the User to view their progress in each course, completed lessons, scores obtained in exercises, accumulated study time and general statistics of their learning.
• Student community: discussion forums, comment sections and interaction spaces where Users can exchange knowledge, resolve doubts, share projects and collaborate with other students on the Platform.
• Completion certificates: verifiable digital documents issued upon successfully completing a Course, as detailed in section 9 of these Terms.
• Personalized mentoring: for Users subscribed to the Mentor plan, individual tutoring sessions with experienced professionals from the technology sector, aimed at resolving advanced doubts, reviewing projects and providing professional guidance.

Digital Edge Consulting LLC reserves the right to expand, modify, update or discontinue any of the Platform's features or services at any time, communicating relevant changes with reasonable notice.

5. Plans and pricing

The Platform offers the following subscription plans:

All prices are expressed in euros (EUR) and include Value Added Tax (VAT) where applicable in accordance with the legislation of the User's country of residence. In territories where VAT does not apply, the price shown will be the final price.

Digital Edge Consulting LLC reserves the right to modify the prices of the subscription plans at any time. Price modifications will not affect subscription periods already paid and will be communicated to the User at least thirty (30) days before they take effect. In the event of a price increase, the User may cancel their subscription before the effective date of the new price.

6. Payment and billing

All payment processing is carried out securely through Stripe, our payment service provider, which complies with PCI DSS Level 1 security standards. Digital Edge Consulting LLC does not directly store complete credit or debit card data on its servers.

• Billing cycle: paid subscriptions (Pro and Mentor) are billed monthly. The charge will be made automatically on the corresponding date of each month, starting from the subscription contracting date.
• Automatic renewal: all paid subscriptions renew automatically at the end of each billing period, unless the User expressly cancels the subscription before the renewal date.
• Accepted payment methods: credit and debit cards (Visa, Mastercard, American Express) and other payment methods enabled through Stripe.
• Electronic invoices: after each charge, an electronic invoice will be automatically generated and available in the User's account settings panel. Additionally, a copy of the invoice will be sent to the User's registered email.
• Non-payment: in the event that it is not possible to process the charge on the scheduled date (due to insufficient funds, expired card or other reasons), up to three (3) additional charge attempts will be made on the following days. If payment cannot be completed after these attempts, the subscription will be suspended until the User updates their payment method or resolves the issue.

7. Cancellation and refunds

The User may cancel their paid subscription at any time through their account settings section or by contacting our support team at [email protected]. Cancellation shall be governed by the following conditions:

• Effects of cancellation: once the subscription is canceled, the User will retain full access to the Content and features of their plan until the end of the billing period already paid. After that period, the account will automatically convert to the Free plan, retaining the progress history and certificates obtained.
• No additional charges: after cancellation, no additional charges will be made. Cancellation must be made before the renewal date to avoid being charged for the next period.
• Reactivation: the User may reactivate their subscription at any time by accessing the plans section of the Platform. Upon reactivating the subscription, the previous progress and account data will be retained.

Refund policy

Digital Edge Consulting LLC offers the following refund guarantees:

• European Union users: in accordance with Directive 2011/83/EU on consumer rights, users residing in the European Union have the right to withdraw from the contract within fourteen (14) calendar days from the subscription contracting date, without the need for any justification. To exercise this right, the User must communicate their decision to withdraw to [email protected] within the indicated period. The refund will be processed using the same payment method used in the original transaction within a maximum period of fourteen (14) days from receipt of the request.
• All users: regardless of applicable legislation, we offer a fourteen (14) day satisfaction guarantee period. If the User is not satisfied with the service for any reason, they may request a full refund within the first 14 days from the subscription contracting or renewal date, by sending their request to [email protected].
• Exceptions: no refunds will be granted once the 14-day period has elapsed, nor in the event of account suspension or cancellation for breach of these Terms.

8. Intellectual property

All Platform Content, including but not limited to video courses, texts, images, graphics, logos, icons, interface design, source code, code examples, exercises, databases and any other material, are the exclusive property of Digital Edge Consulting LLC or the content creators who have assigned their rights to the Company, and are protected by applicable intellectual and industrial property laws.

Subscription to the Platform grants the User a personal, non-transferable, non-exclusive, revocable and limited license to access the Content and use it exclusively for personal learning purposes. This license is subject to the following restrictions:

• The User may not copy, reproduce, download (except where the feature is expressly enabled), record, distribute, transmit, broadcast, display, sell, license or otherwise exploit the Content, in whole or in part, without the prior written authorization of Digital Edge Consulting LLC.
• It is expressly prohibited to share, redistribute, resell or make available to third parties the courses, videos, materials or any other Platform Content, whether free of charge or for consideration.
• The User may not use the Content to create, develop or offer courses, tutorials, educational materials or other products that compete directly or indirectly with the Platform.
• The use of automated tools, bots, scrapers or any other mechanism to extract, copy or collect Platform Content in a massive or systematic manner is prohibited.
• The license of use is automatically terminated upon cancellation of the User's account or subscription.

The code examples provided in the courses for educational purposes may be used by the User as reference and inspiration for their own personal and professional projects, provided they are not redistributed as part of competing educational material.

9. Certificates

The Platform issues digital completion certificates to Users who successfully complete a Course, meeting the assessment and progress requirements established for each particular course. The certificates are subject to the following conditions:

• Issuance: certificates are generated automatically upon completing all required lessons, exercises and assessments of a Course, provided that the User has an active Pro or Mentor subscription at the time of completion.
• Verifiability: each certificate includes a unique identifier and a verification link that allows third parties to confirm the authenticity and validity of the certificate through the Platform.
• Nature of the certificate: the certificates issued by the Platform attest to the successful completion of an online training program. The User is expressly informed that these certificates do not constitute an official academic degree, nor an accredited professional certification, nor a degree, diploma or qualification issued by an accredited educational institution. Their value is that of recognition of supplementary training in the field of programming.
• Retention: the certificates obtained by the User will remain accessible and verifiable on the Platform even after the cancellation of the subscription, provided that the User's account remains active.
• Revocation: Digital Edge Consulting LLC reserves the right to revoke a certificate if it is determined that it was obtained through fraudulent practices, such as cheating, copying solutions from other users or any other form of academic dishonesty.

10. User conduct

The User undertakes to use the Platform responsibly, ethically and in accordance with these Terms, applicable laws and the standards of coexistence of the educational community. In particular, the User agrees to:

• Responsible use: use the Platform exclusively for legitimate learning purposes and in accordance with its educational purpose.
• Academic honesty: complete the exercises, assessments and projects proposed in the courses by themselves. It is prohibited to copy solutions from other users, use automated tools to solve exercises fraudulently, or any other form of cheating that undermines the assessment and certification process.
• No account sharing: maintain the exclusivity of their personal account and not allow its use by third parties. Each account is personal and non-transferable.
• Respect for the community: in the forums, comments and other community spaces of the Platform, the User must maintain respectful, constructive and cordial treatment of other users and the Platform team. It is prohibited to post offensive, defamatory, discriminatory, threatening or obscene content, or content that incites hatred or violence.
• No spam or self-promotion: it is prohibited to use the Platform's community spaces to post advertising, spam, affiliate links or content for exclusively unauthorized promotional or commercial purposes.
• Respect for intellectual property: not to post in the community spaces content protected by third-party intellectual property rights without proper authorization, including code, texts, images or any other material.
• No reverse engineering: it is prohibited to reverse engineer, decompile, disassemble or attempt to discover the source code of the Platform or its internal systems.
• Not to interfere with the service: the User shall refrain from carrying out any action that may damage, overload, impair or prevent the normal functioning of the Platform, its servers or its networks.

Breach of any of the above conduct rules may result in the application of the disciplinary measures provided for in section 14 of these Terms, including the temporary or permanent suspension of the User's account.

11. User-generated content

The Platform allows Users to post content in certain spaces, such as discussion forums, comment sections, shared projects, public profiles and other interactive areas (hereinafter, "User Content"). In relation to such content, the following conditions are established:

• Content responsibility: the User is solely responsible for the content they post on the Platform. Digital Edge Consulting LLC does not pre-screen User Content and assumes no liability for the opinions, statements or information posted by users.
• License granted: by posting User Content on the Platform, the User grants Digital Edge Consulting LLC a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, display and publicly communicate such content in the context of the operation and promotion of the Platform. This license has the sole purpose of enabling the normal functioning of the community spaces and the promotion of the Platform, and does not imply the assignment of the User's copyright over their content.
• User warranties: by posting content, the User warrants that they are the legitimate holder of the rights over it or that they have the necessary authorizations for its publication, and that such content does not infringe intellectual property, privacy or other third-party rights.
• Moderation: Digital Edge Consulting LLC reserves the right to moderate, edit or remove any User Content that, in its sole discretion, breaches these Terms, the community rules or applicable legislation, without prior notice to the User.

12. Service availability

Digital Edge Consulting LLC will make commercially reasonable efforts to keep the Platform accessible and operational continuously, twenty-four (24) hours a day, seven (7) days a week. However, the Company does not guarantee one hundred percent (100%) service availability and shall not be liable for service interruptions that may occur due to the following causes:

• Scheduled maintenance tasks, which will be communicated to Users as far in advance as possible.
• Emergency maintenance necessary to resolve critical security or operating problems.
• Failures in telecommunications networks, third-party servers, or Internet infrastructure beyond the Company's control.
• Cyberattacks, such as denial of service (DDoS) attacks, brute-force attacks or other security threats.
• Force majeure causes, such as natural disasters, power supply interruptions, pandemics, armed conflicts or other unforeseeable and unavoidable circumstances.
• Platform updates, system migrations or infrastructure improvements.

In the event of prolonged service interruptions affecting the availability of the Platform for a continuous period exceeding seventy-two (72) hours, Digital Edge Consulting LLC will assess, at its sole discretion, the possibility of compensating affected Users by extending their subscription period or equivalent mechanisms.

13. Limitation of liability

The Platform is a supplementary educational service designed to facilitate the learning of computer programming. Digital Edge Consulting LLC does not guarantee that use of the Platform or completion of its courses will lead to obtaining employment, a promotion, a salary increase or any other specific professional or economic outcome. Learning outcomes vary depending on multiple factors, such as personal effort, dedication, prior aptitudes, labor market conditions and other circumstances beyond the Company's control.

To the maximum extent permitted by applicable law:

• The Platform and its Content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement.
• Digital Edge Consulting LLC does not guarantee that the Platform is uninterrupted, error-free, secure or free of viruses or other harmful components.
• Digital Edge Consulting LLC shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use, goodwill or other intangible losses, resulting from the use or inability to use the Platform.
• The total and cumulative liability of Digital Edge Consulting LLC toward the User for any claim arising from these Terms or the use of the Platform shall not exceed the total amount paid by the User to the Company during the twelve (12) months immediately prior to the event that gave rise to the claim, or one hundred euros (EUR 100), whichever is greater.

The above limitations shall not affect the rights that applicable law recognizes for the User as a consumer and that cannot be contractually excluded or limited. In particular, for users who have consumer status under European Union regulations, the limitations of liability shall apply only to the extent permitted by EU consumer protection legislation.

14. Suspension and termination

Digital Edge Consulting LLC reserves the right to temporarily or permanently suspend, limit or cancel the account of any User, with or without prior notice, when any of the following circumstances apply:

• Breach of any of the provisions of these Terms & Conditions.
• Fraudulent, abusive or unlawful use of the Platform or its services.
• Sharing access credentials or allowing the use of the account by unauthorized third parties.
• Academic dishonesty, including cheating on exercises or assessments, plagiarism or use of unauthorized means to obtain certificates.
• Posting content that breaches the community rules, third-party rights or applicable legislation.
• Conduct that harms or interferes with the experience of other users or with the normal functioning of the Platform.
• Repeated non-payment of the subscription after the scheduled charge attempts.
• Request by the User themselves to delete their account.

In the event of suspension or cancellation due to a cause attributable to the User, the User shall not be entitled to any refund for unused subscription periods. Certificates legitimately obtained before the suspension will remain valid and verifiable.

Before proceeding with the definitive cancellation of an account for breach (except in cases of serious violations requiring immediate action), Digital Edge Consulting LLC will make reasonable efforts to notify the User and, where appropriate, grant them a reasonable period to remedy the breach.

15. Dispute resolution

In the event of any controversy, claim or dispute arising between the User and Digital Edge Consulting LLC in relation to the Platform, these Terms or the services provided, the parties agree to the following tiered resolution procedure:

• Direct negotiation: in the first instance, the parties will attempt to resolve the dispute in good faith through direct negotiation. The User may send their claim to [email protected], and Digital Edge Consulting LLC undertakes to respond within a maximum period of thirty (30) business days.
• Mediation: if the dispute cannot be resolved through direct negotiation within sixty (60) days, the parties may submit the dispute to a mediation procedure administered by a mutually accepted neutral mediator, based in Albuquerque, New Mexico.
• Arbitration: if mediation does not result in an agreement within ninety (90) days of its commencement, the dispute will be definitively resolved through binding arbitration, administered in accordance with the rules of the American Arbitration Association (AAA), based in Albuquerque, New Mexico. The arbitration award will be final and binding on both parties.

Notwithstanding the foregoing, users who have consumer status under European Union regulations will retain their right to go to the courts of their place of residence for the resolution of disputes, as well as to use the European Commission's online dispute resolution platform (https://ec.europa.eu/consumers/odr).

Nothing in this section shall prevent Digital Edge Consulting LLC from seeking injunctive relief or urgent protective measures before any competent court when necessary to protect its intellectual property rights or prevent irreparable harm.

16. Applicable law and jurisdiction

These Terms & Conditions, as well as the relationship between Digital Edge Consulting LLC and the User, shall be governed and interpreted in accordance with the laws of the State of New Mexico, United States of America, without prejudice to its conflict-of-laws rules.

For those users who have consumer status under European Union regulations, the additional rights recognized by European consumer protection legislation will be respected, including but not limited to:

• The right to bring actions before the courts of the Member State of their habitual residence.
• The application of the mandatory provisions of the consumer protection legislation of their country of residence, when these are more favorable than the laws of the State of New Mexico.
• The withdrawal rights provided for in Directive 2011/83/EU on consumer rights.
• The rights regarding the protection of personal data under the GDPR.

If any of the provisions of these Terms is declared null, invalid or unenforceable by a competent court, such provision will be modified and interpreted in a way that approximates as closely as possible the original intent of the provision, and the remaining provisions will continue in full force and effect.

17. Modifications to the Terms

Digital Edge Consulting LLC reserves the right to modify, update or replace these Terms & Conditions at any time, to adapt them to changes in legislation, in the Platform's services, or in the Company's business practices.

The modifications will take effect from the moment of their publication on the Platform, unless a later effective date is expressly indicated. The date of the last update will always be indicated at the beginning of this document.

In the event that the modifications are substantial or significantly affect the rights or obligations of the User, Digital Edge Consulting LLC will notify such changes at least thirty (30) days before they take effect, through the following means:

• Sending a communication to the email registered in the User's account.
• Publication of a prominent notice on the Platform upon logging in.

Continued use of the Platform after the modifications take effect shall constitute the User's acceptance of the new Terms. If the User does not agree with the modified Terms, they must cease using the Platform and, where appropriate, cancel their subscription in accordance with the procedure established in section 7.
